Social Security Disability

At Swiney & Bellenger, we assist those in need throughout Alabama to receive the Social Security benefits they deserve.

We have represented thousands of hard-working individuals who can no longer provide for themselves or their families due to serious physical or mental impairments. All our case evaluations are free, and you are never under any pressure to make a decision without being fully informed about the process. These cases are also handled on a contingency fee basis which means that we do not receive a fee unless we win your case.

Our founding attorneys, Vincent Swiney and Alan K. Bellenger, are devoted to helping people who need it most. The entire Swiney & Bellenger team is eager to go the extra mile to help you obtain the resolution you are seeking. You can count on us to tackle your legal matters because we have years of experience and have been consistently recognized by our peers in the industry and the media.

There are essentially two types of Social Security Disability benefits available.

Title II benefits

Title II benefits are based upon your past work history.  If you have worked 5 out of the last ten years and paid Social Security taxes, you should be eligible for these benefits.

Title 16 benefits

Title 16 benefits, or SSI, are available for those whose resources fall under a certain level. It is possible to be eligible for both SSDI and SSI benefits.

Each of these programs will ultimately trigger eligibility for Medicare or Medicaid.

We will be glad to review and discuss your technical eligibility for these benefits prior to filing a claim on your behalf.

We are pleased to offer our services from the initial application through any necessary appeals. Unlike many other firms, we file initial applications for our clients. Once the application is filed, we also maintain communication with the client and the different divisions of the Social Security Administration during claims processing to ensure that your claim does not get lost in the shuffle. We also communicate with your doctors and order all your medical and vocational records to ensure that the very best evidence is available during the decision-making process.

It is true that many people are denied their benefits on initial application, but that is not always the case. We routinely win cases for clients on initial application. If, however, you are denied, we are always prepared to take your claim through the Reconsideration process as well as requesting a hearing with an Administrative Law Judge, if necessary. If you have already filed for benefits on your own, we will also be happy to take up your case at the Reconsideration or Appeal level.

At Swiney & Bellenger, if a Social Security Disability hearing with an Administrative Law Judge is necessary, you can be assured that you will be well prepared. We take the time to review every document in the file to understand the strengths and weaknesses of the evidence. We also explain the decision-making process to the clients in advance of the hearing. A five-minute conversation prior to a hearing is an unacceptable level of preparation. It is vital that you understand the issues in your case. It is also vital that you understand what the Judge expects from your testimony. It is our job to make sure you are as confidant as you possibly can be at your hearing, and that is an obligation that we take very seriously.

During the last few years, the world has changed due to the extraordinary circumstances of the Covid-19 pandemic. One of the changes that we have experienced in the Social Security world is that currently and for the foreseeable future, the hearings offices are closed, and we are not conducting in-person hearings. Most hearings are being conducted either by telephone or through hosting technology. We will work with you to make sure you are comfortable with whatever way we decide to proceed with the hearing. We take pride in having our office in a restored one hundred-year-old house in the suburb of Homewood that has plenty of parking, is easy to find and a ground floor entry. You won’t have to fight traffic, deal with a parking deck, or walk city blocks to get to our office.

If you are in the process or considering Social Security benefits, please call us today.
